Terms & Conditions – GBP Performance

Welcome to gbpperformance.ca (the “Site”). These terms and conditions (the “Terms”) form a legal agreement between you (the “Customer”) and GBP Performance (the “Merchant”, “GBP”, “we”, “us”). By accessing the Site, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. You also agree that our communications may be provided electronically (email, confirmations, notices) and that such communications satisfy any legal requirement for written notice.

We reserve the right, at our sole discretion, to refuse service to any customer, cancel an order, suspend or close an account, modify Site content, or update these Terms, in accordance with applicable laws.

1) Eligibility and customer information

Products and services offered on the Site are intended for individuals who have reached the age of majority in their province or territory (18 years old in Quebec). By using the Site, you represent and warrant that you meet this requirement. You also agree to provide accurate, current, and complete information when creating an account and when placing an order (name, address, email, etc.).

2) Pricing, descriptions, and availability

We do our best to provide accurate information (prices, descriptions, compatibility, inventory), but errors may occur. We reserve the right to correct any error and to refuse or cancel an order that contains a clear pricing, description, or availability error, even after confirmation.

Unless otherwise stated, prices are in Canadian dollars (CAD). Applicable taxes are added at checkout based on your province/territory of residence.

Please note that the prices displayed for wheels and tires are calculated based on the purchase of a complete set (4 units). Additional charges will be applied when processing any order of less than 4 units, according to the following scale:

  • For 1 unit: $29.95+tx fees
  • For 2 units: $19.95+tx fees
  • For 3 units: $9.95+tx fees

These charges will be added to the total amount and payment will be requested when your order is processed.

3) Orders, confirmation, and tracking

When you place an order, a confirmation is displayed on-screen and an order number is generated. You can view your order status at any time through your customer account (when updates are available). The generation of an order number confirms that the sale has been concluded under these Terms, subject to security checks and the rules set out herein.

4) Payment

We accept Visa, Mastercard, PayPal, as well as Interac e-Transfer (when offered or required by GBP Performance). Depending on the payment method and our processes, payment may be captured/charged later (for example, at the time of processing or shipment). By placing an order, you authorize GBP Performance to capture/charge the payment associated with your order in accordance with these Terms.

For security reasons, some orders with a total value above $3,500 CAD may not be payable by credit card or PayPal. If your order exceeds this amount, a representative may contact you to arrange payment by Interac e-Transfer or another solution deemed appropriate. If the required payment is not completed within the specified timeframe, we may cancel the order.

5) Shipping address

The Customer is responsible for providing a complete and accurate shipping address. For security reasons, we ship to the address provided at checkout. Requests to change the address after purchase may be refused. If a parcel is returned due to an incomplete/incorrect address or for any reason attributable to the recipient, the rules in the “Unclaimed / Return-to-Sender Parcels” section apply.

6) Shipping and delivery

We ship anywhere in Canada. The carrier is selected by GBP Performance based on package type, destination, and the best available service. We use, among others, Purolator, Canpar, Loomis, UPS, FedEx, GLS, Canada Post, etc.

Processing and shipping timelines: Orders are generally processed within 24 business hours. Delivery times then vary depending on the destination (on average an additional 1 to 7 business days), unless otherwise stated on the product page. While we do everything we can to ensure fast delivery, these timelines are estimates and factors beyond our control (weather, carrier delays, etc.) may cause delays. GBP Performance is not responsible for delivery delays attributable to carriers or unforeseen external circumstances.

Free shipping: Standard shipping is free on most orders, unless otherwise stated on the product page or at checkout.

Exceptions – possible additional shipping fees: Despite free shipping, certain shipments may incur additional fees charged by carriers, including (without limitation): remote areas, zone surcharges, OVERSIZE parcels (out-of-gauge dimensions), heavy weight, special handling, long/bulky items, and liquid products (e.g., oils and fluids). If additional fees are required, we will contact the Customer by email before shipment to advise the amount due (the difference in shipping). The order will not be shipped until these fees are paid.

Transfer of risk: Subject to applicable laws, the risk of loss or damage transfers to the Customer once the parcel is handed over to the carrier. If a parcel is lost or damaged in transit, GBP Performance will reasonably assist the Customer with the carrier claim process (proof, tracking, documentation), without guaranteeing the outcome.

7) Order cancellations

Once an order is placed (on-screen confirmation and order number generated), it cannot be cancelled, modified, or withdrawn, even if it has not yet shipped and even if payment is captured later. Orders are processed quickly and may trigger picking/packing, inventory reservation, or supplier steps.

In very rare cases, and only if GBP Performance agrees in writing, a cancellation request may be considered before shipment (with no guarantee of acceptance). If a cancellation is exceptionally accepted, please note that an administrative fee equal to 10% of the order value, calculated before taxes, with a minimum of $15.00 (before taxes) per order, will be deducted from the refund to cover payment processing and cancellation handling costs.

Once an order is being prepared, packed, handed to the carrier, shipped, or if an item has been ordered from a supplier (including any made-to-order item), no cancellation is possible, without exception.

8) Returns, exchanges, and refunds

GBP Performance offers a 30-day return/exchange policy from the date of delivery (delivery proof prevails), except as otherwise stated herein. Returned items must be in their original packaging, complete, unopened where applicable, never installed, and never used.

Return authorization (RMA): All returns or exchanges must be authorized in advance. You must obtain an RMA number and follow the provided instructions. No return will be accepted without an RMA.

Return label (control and tracking): To ensure return control and tracking while the parcel is on its way back to us, GBP Performance provides the return label. The cost of this label is paid by the Customer, except in the event of our error or a product that is defective upon receipt (see below). The Customer agrees to use the provided label; returns shipped otherwise may be refused or may cause delays/adjustments.

Return costs and outbound shipping costs: Except in the event of our error or a product defective upon receipt, the Customer bears the costs associated with the return (including the return label). In addition, outbound (initial) shipping costs are non-refundable. If the order was displayed as “free shipping,” the Customer acknowledges that GBP Performance paid actual carrier shipping fees; if a return is eligible, the actual outbound shipping cost paid by GBP Performance will be deducted from the refund.

Restocking fees: Restocking fees apply to eligible returns. These fees are a minimum of 20% and may be up to 40%, depending on the product type and/or manufacturer/distributor requirements. These fees will be deducted from the refund.

Exchanges: Exchanges are possible if the item is eligible for return and meets the conditions above. Shipping costs associated with an exchange (return + reshipment) are paid by the Customer, except in the event of our error.

Our error / defective upon receipt: If we shipped the wrong item or if an item is received defective/damaged upon receipt, the Customer must notify us promptly with proof (photos/videos). In such cases, we will provide instructions and the return label cost may be covered by GBP Performance, depending on the situation and in accordance with applicable laws.

Damage or missing parts: Any claim for visible damage, severely damaged packaging, or missing parts must be reported within 24 hours of delivery by emailing RMA@gbpperformance.ca

 with photos.

9) Refused parcels

If the Customer refuses a parcel (refusal at delivery, refusal at pickup counter, voluntary return to the carrier, or any “Return to Sender” caused by refusal), the parcel is treated as a Customer-initiated return. In this case, an automatic 25% fee applies. This 25% fee replaces the restocking fee (20% to 40%).

In addition, the outbound shipping cost paid by GBP Performance is charged to the Customer and will be deducted from the refund (if a refund is applicable), as will any other carrier fees billed (e.g., return-to-sender fees, OVERSIZE surcharge, remote area surcharge, etc.).

10) Unclaimed / Return-to-Sender parcels

If a shipment is returned to GBP Performance because it was unclaimed (notice left and the parcel not picked up), because the address provided was incomplete/incorrect, or for any reason attributable to the recipient, no free reshipment will be provided.

The Customer must choose one of the following options:

Option A – Reshipment: The Customer may request reshipment. In that case, reshipment fees and any return-to-sender fees charged by the carrier are entirely at the Customer’s expense and must be paid before reshipping.

Option B – Cancellation / refund (if eligible): If the item is eligible for return, a refund may be issued, less (i) the outbound shipping cost paid by GBP Performance, (ii) any return-to-sender fees charged by the carrier, and (iii) applicable restocking fees (minimum 20% up to 40%), where applicable. If the item is not eligible for return (final sale, non-returnable, special order), no refund will be possible.

11) Non-returnable items

Certain items, due to their nature, manufacturing, or use, are not eligible for returns or exchanges (unless they are defective upon arrival or we made an error, as explained above). This rule exists for hygiene, safety, anti-fraud, or because an opened item cannot be resold as new. The following list includes non-returnable items (final sale):

Oils, liquids, and chemicals: for example, engine oil, transmission fluids, coolant, additives, lubricants, cleaners, etc. (These items cannot be taken back once sold due to shipping restrictions and the difficulty of guaranteeing integrity after opening.)

Electronic and electrical products: any electronic component, module, control unit, sensor, electrical device, etc., once sold, is final sale. (Electronics can be damaged by improper installation or temporarily used/copied; therefore they cannot be returned for a refund.)

Internal engine and transmission parts: this includes internal engine components (pistons, crankshafts, camshafts, valves, etc.), internal transmission or differential parts, and generally any “internal mechanical” powertrain component. (Given the critical nature of these parts and the risk they have been installed, we cannot accept returns on them.)

Turbos and superchargers: turbochargers, superchargers, and forced-induction kits, including related components, are non-returnable. (These are expensive, sensitive performance parts often installed immediately and cannot be resold as new afterward.)

Fuel injection systems: high-performance injectors, fuel pumps, fuel rails, water/meth injection systems, and fuel system-related parts are not eligible for return once sold.

Wheels and tires: all wheels (rims) and tires, once ordered and/or delivered, are final sale and cannot be returned. This is because handling, test-fitting, or mounting can leave marks and they cannot be resold as new.

Other items identified as non-returnable: certain final-sale promotions, clearance items, open-box items, used/demo products, and gift cards (if applicable) are also final sale with no return option. In addition, any item sold as a special order (see next section) is not returnable.

Any product identified as a special order or made-to-order / ordered specifically for the customer is also non-returnable.

12) Special orders

Special order products are clearly identified on the Site (marked “special order”). In such cases, we require payment by Interac e-Transfer. Because a special order is ordered or built specifically for the Customer, it is non-cancellable, non-refundable, and non-returnable once confirmed.

13) Product images

Photos/visuals on the Site may be generic manufacturer images and may not always represent the exact product included. The Customer must rely on the description and part number. If the Customer orders the wrong product, any eligible return is subject to this return policy, including outbound shipping costs, the return label cost, and restocking fees.

14) Warranty and limitation of liability

Subject to applicable laws, products are covered by manufacturer warranties where available. GBP Performance is not responsible for installation, labor, or diagnostic costs, nor for damages resulting from improper installation or misuse. To the extent permitted by law, GBP Performance will not be liable for indirect damages (loss of profits, vehicle downtime, data loss, etc.), and any liability that cannot be excluded is limited to the amount paid for the relevant product.

15) Comments and conduct

You are responsible for any content you post. Illegal, defamatory, threatening, obscene, or rights-infringing content is prohibited. We may remove content at our discretion.

16) Intellectual property

The Site and its content (texts, images, logos, trademarks) are protected by intellectual property laws. Any unauthorized use is prohibited.

17) Governing law and jurisdiction

These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada. Any legal action against GBP Performance must be brought before the judicial district of Laval (Quebec), Canada, subject to mandatory consumer protection provisions.
